1. Definition and Scope of the Contract

1.1 The general conditions of sale (“General Conditions”), which regulate this distance contract, are governed in accordance with art. 50 of L. Decree no. 6 September 2005, no. 206 (“Consumer Code”). The contractual relationship has as its objective the sale of movable goods (hereinafter also “goods” and/or “products”) between the company Reda Industries S.r.l., Via Robiolio 25, 13835 Valdilana (BI), VAT number 01686900026 (“Lanieri”) and the consumer (the “Customer”). The contract is deemed concluded directly through the acceptance by Lanieri of a purchase proposal issued by the Customer by telephone or via the Internet on the page www.lanieri.com (“Website”) and/or through other Lanieri distance selling systems, based on the methods described in art. 3 below.

1.2 These General Conditions and, specifically, the information referred to in art. 59 of the Consumer Code, as provided by Lanieri during the sale, possibly repeated by telephone to the Customer and reported on the Website, remain valid and effective until they are modified and/or integrated by Lanieri. Any changes and/or additions to the General Conditions will be effective from the date on which they are communicated to the public and will apply to sales made from that date. The latest updated version of these General Conditions is the one available on the Website.

2. Prices

2.1 The sales prices of the products illustrated during the sale, on the Website and/or through any other of Lanieri’s remote sales systems are inclusive of VAT and/or any other tax. Delivery costs are indicated during the sale, on the Website and/or through any other of Lanieri’s remote sales systems.

2.2 The prices of all products are to be understood as inclusive of VAT and/or any other tax. In addition to the price of the product at the end of the purchase process, the cost of shipping based on the customer's address may be added.

3. Purchase and payment methods

3.1 The Contract is finalised at the time of payment, by sending the order confirmation to the Customer.

3.2 The Customer has 24 hours to withdraw from the contract and obtain a full refund, without any penalty and without specifying the reason. After 24 hours, it will no longer be possible to cancel the order as the processing procedure and the procedure of creating the made-to-measure item will have begun.

3.3 The Customer can choose one of the following payment methods: credit card, prepaid debit card, PayPal, bank transfer or any other means of payment indicated from time to time as valid by Lanieri via teleshopping broadcasts or on the Website. No commission will be payable by the Customer for any payment method chosen.

3.4 Should the customer purchase multiple items of the same product category for the first time, Lanieri will initially tailor a single item (by agreement with the customer), to verify its correct fit. As soon as this is confirmed by the customer, Lanieri will tailor the remaining items.

3.5 Creating multiple profiles linked to a single physical person and/or related set of body measurements is prohibited. Any profiles that do not comply with this rule will be suspended. Any right of withdrawal/refund claimed on orders placed with irregular profiles will lapse. If discount codes have been used to make purchases from irregular profiles, payment of the amount relating to the discount applied will be required. In the event of failure to pay the balance, the order will not be shipped to the customer.

4. Delivery of products – complaints

4.1 The times required to make the made-to-measure item are indicated when choosing the product. Lanieri delivers the products to the address indicated by the Customer within 35 (thirty-five) days of finalising the order*. During the creation of the item, the Customer can be constantly informed concerning the status of the order by accessing his/her personal page on the Website (Account – Orders).

*The estimated shipping date may vary depending on the payment method and the date of confirmation of the body measurements. During national holidays, there may be delays due to factory closures. Any change in delivery times will be communicated to the Customer via email.

4.2 When the goods are shipped, the Customer will receive an email to the address indicated at the time of the order containing the tracking number through which it is possible to monitor the progress of the delivery.

4.3 If the Customer does not receive the goods or the shipment is subject to delays which have not been communicated, the Customer can follow the instructions in the “Shipment” section or contact Customer Service through all the means indicated in the “Contact Us” section.

4.4 Every Lanieri product is made according to a specific non-industrial production process. This implies that a variation tolerance of 1 cm in the measurements of the tailored garment with respect to the specific measurements of the paper patterns is envisaged and allowed.

4.5 Lanieri constantly invests in offering a photographic representation of its products that is as realistic as possible. Despite this, due to the digital rendering of images on the web, the various light settings of the screens or other external conditions, it is in any case possible that the representation of the products online should not be completely in line with reality. By proceeding with the purchase, the customer accepts that there may be small discrepancies in this regard.

5. Customer Obligations

5.1 The Customer declares and guarantees: (i) to be a consumer as per art. 3 of the Consumer Code; (ii) to be of age; (iii) that the data it has provided for the performance of the Contract are correct and truthful.

6. Right of withdrawal

6.1 The Customer has the right to withdraw from the Contract stipulated, without any penalty and without the obligation to specify the reason, within 24 hours of receiving the order confirmation. The Customer may exercise the right of withdrawal, within the aforementioned time schedule, by expressing the desire to withdraw from the contract by telephone or by email. Once the production process of the made-to-measure and personalised item has begun, it will no longer be possible to cancel the order.

6.2 Pursuant to art. 59, second paragraph, of the Consumer Code, the Customer does not have the right of withdrawal in the case of supplying made-to-measure and/or personalised products.

To ensure a high level of service, Lanieri provides for refunding the amount spent upon return of the products purchased within 30 (thirty) days of shipment of the goods, if the tailored item has: structural imperfections, problems with the fit or the impossibility of making alterations. Conditions specified in the Returns and Refunds section.

In this case, the Customer must proceed as follows:

- Download the Refund Request Form found in the specific section "Alterations and Refunds" section. Complete the form and send it via email to customercare@lanieri.com or by registered post to the address provided below, attaching 3 photos of the garment whilst worn (front, side and back view) clearly showing the defect.

– The complaint is reviewed by our Style Advisors, who will notify its possible approval.

- The garment to be returned must be packaged in its original packaging and sent at the customer's expense, together with the approved Return Form, using a traceable shipping method to the following address:

Within 7 (seven) business days of receiving the returned garment, the refund will be issued using the same payment method used at the time of purchase, where possible (Credit Card via website, PayPal). Otherwise, the customer must provide their bank details on the Return Form to receive the refund.

6.3 Any product sent without following the above procedure will not be accepted and will be returned to the sender, without issuing any refund.

6.4 The product must be returned intact (i.e. unused and complete with all original packaging and accessories) together with the approved Return Form.

6.5 Once the above conditions have been met, the purchaser is entitled to a refund of the full amount excluding shipping costs. Coupons or Discount Vouchers used to purchase the garment will be replaced with new Coupons or Discount Vouchers to be used for future purchases. If the product was purchased as part of a promotion, the customer must return all products included in the promotion to receive a full refund. Any unreturned products will be charged at full market value.

7. Jurisdiction

7.1 The Contract is governed by Italian law.

7.2 Any dispute relating to the application, performance, interpretation and breach of these General Conditions will be under the jurisdiction of the Court in which the Customer has his/her residence or domicile, if located in the territory of the Italian State, or of the Court of Milan, if the Customer has his/her residence or domicile abroad.
